Please read these Terms of Use ("Terms") carefully before using the www.justbeautiful.art website (the "Service") operated by Just as Beautiful Imagery, LLC ("us," "we," or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms and the Terms of our web service provider, Pixiset Media Inc. If you disagree with any part of the terms, you do not have permission to access the Service.

1. Intellectual Property and Copyright

All content, features, and functionality on this website, including but not limited to photographs, images, text, graphics, logos, and digital downloads (collectively, the "Content"), are the exclusive property of Just as Beautiful Imagery, LLC or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.

A. Limited License for Personal, Non-Commercial Viewing

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service solely for your personal evaluation, purchasing, and non-commercial viewing of the Content.

You may not copy, reproduce, republish, upload, post, transmit, distribute, or otherwise use the Content in any way for commercial purposes without our express prior written permission.

B. Prohibited Use (Digital Content)

Unless otherwise explicitly noted, the following is strictly prohibited:

Downloading, screen-capping, or printing any images from the portfolio for public display, distribution, or reproduction.

Removing or obscuring any copyright, watermarking, or other proprietary notices contained in the Content.

Modifying or creating derivative works from the Content.



Using images as a basis for AI/ML training, digital artwork, NFTs, or any other digital or physical creation without a specific commercial license from us.

C. Trademarks

All company names, logos, product names, and related marks are trademarks of Just as Beautiful Imagery LLC and may not be used without our prior written permission. All other names, logos, and marks displayed on the Service are the property of their respective owners.

2. Licensing and Purchases

Licensing: All commercial use of our photographs (including use in advertisements, marketing materials, blogs, or print publications) requires a specific, legally binding license agreement from us. The terms of any such license will be defined separately from these Terms of Use.

Purchases: Any purchase of products (e.g., prints, merchandise, or digital image files) through the Service if governed by our Terms of Sale, which are hereby incorporated by reference into these Terms.

Digital Image Licensing: The purchase of any digital file is also subject to the Digital Image License Agreement (Personal Use), which governs your personal-use rights and restrictions

3. User Conduct

You agree to use the Service only for lawful purposes and not to engage in any activity that interferes with or disrupts the Service. Prohibited activities include, but are not limited to:

Attempting to interfere with the proper working of the Service.

Using any automated means, such as robots, spiders, or scrapers, to access, extract, or monitor any portion of the Content.

Transmitting any data that contains viruses, Trojan horses, worms, or any other harmful code.

Impersonating or attempting to impersonate Just as Beautiful Imagery, LLC, a company employee, another user, or any other person or entity.

If any provisions of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provisions shall not be deemed a waiver of those rights.

4. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

5. Disclaimer and Limitation of Liability

Accuracy: We do not warrant that the content on this site is entirely accurate, complete, or current. We may make changes to the Service and Content at any time without notice.

"As Is" Basis: Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.

Liability: In no event shall Just as Beautiful Imagery, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to your use of the Service shall not exceed the greater of (a) the total amount you paid for products or services purchased through the Service, or (b) one hundred dollars ($100).

Any claim or cause of action arising out of or related to these Terms must be commenced within one (1) year after the claim accrues; otherwise, it is permanently barred.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions.

You agree that any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Missouri, and you consent to the jurisdiction of such courts.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 15 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

8. Indemnification

You agree to defend, indemnify, and hold harmless Just as Beautiful Imagery LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys’ fees) arising out of your use of the Service or your violation of these Terms.
